This website is operated by Arkansas Marine & Off-Road. Throughout these Terms, “we,” “us,” and “our” refer to Arkansas Marine & Off-Road. By visiting our website, purchasing a product, requesting a service, or otherwise using our website and related services, you agree to these Terms of Service.

1. ELIGIBILITY AND ACCOUNTS


You must be at least the age of majority in your state of residence to make a purchase. You agree to provide accurate, complete, and current billing, shipping, payment, and contact information.


You are responsible for maintaining the security of your account credentials and for activity conducted through your account.


2. PRODUCTS AND AVAILABILITY


We make reasonable efforts to display accurate product descriptions, specifications, images, pricing, and availability. Product colors and appearance may vary depending on your screen or device.


Many products are supplied or fulfilled through authorized distributors or manufacturers. Availability can change without notice. Placing an order does not guarantee availability. If an ordered product becomes unavailable, we may contact you about a substitute, delay, cancellation, or full refund.


We may correct product information, pricing, or availability errors and may limit quantities or discontinue products at any time.


3. ORDERS


Submitting an order is an offer to purchase. We may accept, decline, change, or cancel an order for legitimate business reasons, including product unavailability, pricing errors, suspected fraud, payment problems, shipping restrictions, or supplier limitations.


An order is not considered accepted until payment is authorized and we confirm or begin processing it.


Review your order carefully before submitting it. Orders may be transmitted to a distributor shortly after purchase and might not be cancelable once processing or fulfillment begins.


4. PRICING, PAYMENT, AND TAXES


Prices and promotions may change without notice. The price displayed when an order is placed generally applies unless there is an obvious pricing or listing error.


You agree to pay all charges associated with your order, including applicable taxes and any clearly disclosed shipping or service charges.


We use Shopify and approved payment providers to process transactions. We do not directly store complete payment-card information.


5. SHIPPING AND DELIVERY


We currently ship online product orders within the United States. Eligible orders receive free standard shipping unless otherwise stated at checkout.


Standard delivery is estimated at 5–8 business days. Delivery dates are estimates and are not guaranteed. Supplier processing, carrier delays, weather, address problems, high-volume periods, and events outside our control may affect delivery.


Customers are responsible for providing a complete and accurate delivery address. Contact us immediately if you discover an address error. We cannot guarantee that an address can be changed after fulfillment begins.


Inspect all packages promptly. Report missing, incorrect, or visibly damaged merchandise as soon as possible and preferably within 48 hours of delivery. Keep the product, packaging, shipping label, and packing materials while the claim is reviewed.


6. RETURNS, REFUNDS, AND CANCELLATIONS


All returns, refunds, and cancellations are governed by our Return and Refund Policy:

A return authorization is required before sending merchandise back. Items sent without authorization may be refused.


Opened, installed, used, modified, improperly wired, or damaged products might not qualify for return. Original outbound shipping costs may be deducted from an approved non-defective return, including an order that originally received free shipping.


7. INSTALLATION AND OTHER SERVICES


Product purchases do not include installation unless installation is expressly listed in the order or a separate written estimate.


Installation, diagnostic, tuning, repair, and custom-fabrication services may require a separate estimate, work authorization, deposit, or service agreement.


Customers must provide accurate information about the vehicle, boat, ATV, UTV, equipment, and existing electrical system. Undisclosed damage, unsafe wiring, corrosion, prior modifications, restricted access, or additional required work may affect price and completion time.


Completed labor, installation, diagnostic, tuning, and custom-fabrication services are generally non-refundable, subject to applicable law.


8. PRODUCT USE, INSTALLATION, AND WARRANTIES


Audio, lighting, electrical, and off-road products must be installed, wired, fused, tuned, and operated correctly. Improper installation or use can damage equipment, vehicles, boats, batteries, charging systems, or other property and may create a safety hazard.


Follow all manufacturer instructions and use qualified installation assistance when appropriate. Arkansas Marine & Off-Road is not responsible for damage caused by improper installation, wiring, tuning, misuse, unauthorized modification, abuse, or failure to follow manufacturer requirements.


Products may include a manufacturer warranty. Warranty coverage, duration, exclusions, and claim approval are controlled by the applicable manufacturer. Contact us before sending a product to a manufacturer or distributor.


Nothing in these Terms excludes rights or warranties that cannot legally be excluded.


9. THIRD-PARTY FINANCING AND SERVICES


We may offer payment or financing options provided by third parties, including installment-payment companies. Arkansas Marine & Off-Road is not the lender and does not determine financing approval, credit limits, interest rates, payment schedules, late fees, or other financing terms.


Financing applications and agreements are governed by the provider’s terms and privacy practices. Approval is not guaranteed. Questions about a financing agreement or customer payments should be directed to the financing provider.


Our website may also contain links, applications, or services operated by third parties. We are not responsible for third-party websites, content, availability, or separate transactions.


10. INTELLECTUAL PROPERTY


The website and its original design, text, graphics, logos, photographs, videos, and other content are owned by Arkansas Marine & Off-Road or used with permission from manufacturers, suppliers, licensors, or other rights holders.


Manufacturer names, logos, product images, and trademarks belong to their respective owners. You may not reproduce, distribute, modify, republish, or commercially exploit website content without permission from the applicable rights holder.

Our total liability relating to an online product transaction will not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any dispute not otherwise resolved will be subject to the courts with proper jurisdiction serving Lonoke County, Arkansas, unless applicable law requires otherwise.

We may update these Terms by posting a revised version on this page. Changes become effective when posted unless a later effective date is stated. Continued use of the website after an update constitutes acceptance of the revised Terms.
